Wage and Hour
Denied minimum wage or overtime? Hourly employees in Texas are covered by federal laws, most notably the Fair Labor Standards Act (FLSA), which mandates a federal minimum wage of $7.25 per hour and overtime pay at 1.5 times the regular rate for hours worked over 40 in a workweek. Texas law requires employers to pay at least twice a month and ensures that employees can file wage claims with the Texas Workforce Commission (TWC) if they are not paid correctly. Independent Contractor Misclassification
Misclassified workers are entitled to the benefits and wages of an employee, including overtime pay and other benefits like sick leave or health insurance contributions. To determine the correct classification, Texas uses a “how it walks and quacks” test, evaluating the employer’s control over the work, the worker’s opportunity for profit or loss, their investment in equipment, the permanence of the relationship, and the integration of their work into the business.
